The three Appellants, stood trial before the District Court of Kilombero charged with two counts. In the first count, the Appellants were charged jointly and together with armed robbery contrary to section 287A of the Penal Code [Cap 16 R.E. 2002] and immediately before such stealing they used a piece of iron to beat and assault Wiston Kikoti in order to obtain and retain the said properties. The second count of unnatural offence was that the trio, after committing the offence of armed robbery, they had carnal knowledge of Happy Adam against the order of nature. At the end of the trial, they were found guilty, convicted and sentenced to 30 (thirty) years term of imprisonment, each. The Appellants who were not satisfied with the trial court’s decision appealed to this court against both conviction and sentence.
