This appeal originates from the decision of Resident Magistrate Court for Dar es Salaam at Kisutu. The matter before the Court based on a publication originated by the Appellant and published in Mwananchi Newspaper, a daily newspaper owned by the 2nd Respondent. The publication which was in form of a public notice issued to the effect that the 1st Respondent was no longer the employee of the Appellant. This discontented the 1st Respondent. He successfully sued the Appellant and the 2nd Respondent for defamation and the Court decided in his favour. The Appellant was dissatisfied hence the current appeal challenging the finding of the Resident Magistrates’ Court. The main issue was whether the Resident Magistrates’ Court had jurisdiction to entertain a defamatory case which emanates from a labour matter.
