This was a ruling emanating from a preliminary objection
raised by the Respondent’s counsel. The counsel contended that the drawn order
appealed against was defective as it offended the provisions of Order XX rule
of the CPC which requires the date of the decree or order appealed against to
bear the same date of the delivery of the ruling.
