The Appellant was sued at the trial tribunal for land trespass. The Application was heard and decided ex-parte on the ground that the Appellant refused service. Attempt by the Appellant to set aside the ex-parte decision was dismissed leading to this appeal which challenged the manner in which the summons was served to him.
