The Applicant prays for time extension of time to file application for revision of Civil Case No. 40 of 2000 at the Kinondoni District Court (which was at some points described as RM Civil Case No. 40 of 2000 at Kisutu RM’s Court) and was determined in a judgment titled Civil Case No. 40 of 2000 given by the Ilala District Court. The resultant decree was issued by the Kisutu RMs Court in Civil Case No. 40 of 2000. The reason for this is that the learned Magistrate who was assigned the case (Kabuta, RM), moved with the file from Kinondoni District Court to Kisutu RM’s Court and ultimately Ilala District Court as she was being transferred from one Court to another. While the case was instituted in Kinondoni District Court where the property in dispute is situated, the judgment was handed down by the Ilala District Court and the decree was issued by the RM’s Court, Kisutu. It is for this reason that the Applicant herein intends to file an application for revision, so that whatever irregularities there had been may be rectified. Seven years had passed from the time the decree was issued to the date this application was filed. The Applicant also states that after the judgment, the case file could not be traced for a long time, which resulted in him being unable to act within time as the different references of the case kept confusing the courts as to the whereabouts of the file and the correctness of the record.
