The Appellant unsuccessfully filed a suit before the trial court on allegation that he was defamed by the Respondent. The defamatory words directed to the Appellant were “mbwa”, “mjinga” “and “sina akili”. Aggrieved by the decision, he appealed to this Court on the ground that the defamatory words directed to the Appellant were not disputed by the Respondent during the trial. The Respondent disputes the appeal arguing that there was no defamation as there was no proof that the alleged defamatory words were communicated to a third party.
