The defendants herein in response to the plaint, filed their joint written statement, which contained two preliminary objections on points of law. The parties were allowed to argue the preliminary objections by way of written submissions where a scheduled order was fixed. However, the defendants’ counsel did not file their submission and the Plaintiff’s counsel moved the Court to strike out the notice of preliminary objection since the defendants had failed to prosecute the same. In response to the foregoing prayer, counsel for the defendants filed their reply where they contended that the failure to file their written submission was not intentional but due to technological problems wherein their computer was off service. That they were waiting to pray for extension of time to file the same during the mention of the case. They thus prayed for extension of time.
