The Appellants filed a suit on behalf of 215 villagemates before the District Land and Housing Tribunal of Dodoma against the Respondent for declaration that 230 acres of land belongs to them. The Respondent strongly opposed the claim on the ground that the disputed land was legally under the care of Mvumi Makulu Village Council for and on behalf of the residents of that village. That the Appellants and others had shifted from the suit land in 1971 during Operation Vijiji and were allocated alternative land. After failure of the Operation Vijiji policy, the Appellants returned to the suit land in 2001 but in 2005, the village government asked them to vacate the same. It was thus ruled that the Appellants were trespassers in the land as the same had been legally under the control of the Village Council. The trial tribunal, however, ordered the Village Council to allocate two acres of land each to 11 households who were found living in the suit land during the visit, including the three Appellants herein. The suit was otherwise dismissed with costs.
