The three accused were jointly and together charged with the offence of murder. They all pleaded not guilty to the charge. The evidence relied by the prosecution against the three accused persons was that of PW1, the only eye witness of the incident. The offence was committed at night. The evidence implicating the three accused persons with the offence they were charged with was entirely of their identification. In this case neither of the three accused persons was arrested at the scene of crime committing the offence they were facing. They were singled out by PW1 to be the ones who, with others who were not arrested, assaulted the accused. According to PW1, when he with the deceased arrived at the music hall, they sought to enter the hall, but when the deceased was entering, the 1st accused, who was drunk and hanging over, bumped on the shoulder of the deceased and started to bleed from his mouth. The 1st accused moved out of the hall, but his friends, who he mentioned to be the 2nd and 3rd accused convinced him to revenge. These friends of the 1st accused who were at the time outside the hall entered, followed the deceased and beat him to death. PW1 said there was a light bulb about 15 walking steps from the entrance which could not clearly illuminate the entrance. According to PW1, the first beating of the deceased happened in the music hall. PW1 testified that there were many other people in the music hall other than the accused persons and at least seven of them invaded and beat up the deceased. The incident, according to the evidence adduced, seemed to have taken a very short time and the place was very crowded.
