The Appellant instituted a suit in the Primary Court Kasenyi in Sengerema District against the Respondent, a traditional healer claiming Tanzanian Shillings 1,000,000/= being refund of monies and value of one cow he paid to the Respondent as medical fees/charges on account of his sick child who was being treated by the Respondent. The promised healing of the child in a short time did not take place as expected. He won the case in the Primary Court but lost it on appeal to the District Court. He further appealed to the High Court which considered the issue of certainty of contractual terms.
