The Appellant lodged an application with the District Land and Housing Tribunal of Dodoma, after he found out that a plot which had been left by his late son had been bought by the first Respondent. He disputed the ownership of the said land by the first Respondent on the ground that the Appellant had already been appointed the administrator of the said estate yet no one had come seeking to buy the said suit premises from him. Furthermore, the Appellant had realized that the title deed of the suit premises had been stolen. He was baffled that the first Respondent had managed to buy the suit premises in the deceased’s name. The trial tribunal had held in favour of the first Respondent. Being aggrieved, the Appellant appealed to the High Court of Tanzania.
