The Appellant had successfully filed an Application for letters of administration of the estate of her deceased father at the Mombo Primary Court. The Respondent is the Appellant’s mother and the deceased’s wife. She opposed the Application in the Primary Court and successfully appealed to the District Court of Korogwe. The District Court decision was that the application was brought up after many years and that the Appellant was time-barred to claim recovery of house in which the Respondent is living. The Appellant appealed against that decision.
