One Mwamvita Hamisi filed an application in a primary court to be granted letters of administration of the estate of her deceased father, Hamisi Mboryo. She described herself as the only surviving child and heir of the deceased. The Court declared her as the rightful heir and granted her the letters of administration. Subsequently, another person one Shada d/o Hamisi, who also identified herself of a child of the said Hamisi Mboryo, filed an objection claiming that Mwamvita Hamisi had lied to the court that she was the only surviving child of the late Hamisi Mboryo, which was not the case. The Court then revoked the letters of administration that had been granted to Mwamvita Mboryo. Instead, it appointed both of them as administratices and declared them as the only rightful heirs of the deceased’s estate. The High Court considered the propriety of such a declaration.
