The Appellant was sued for the payment of Tanzanian Shillings 8,761,500/= being a value of 531 bags of sardine fish entrusted to the Defendant. The trial Court gave the judgment in favour of the Plaintiff. The Appellant applied for the execution of the decree by attachment and sale to the Resident Magistrate Court which dismissed the application on the ground that the Primary Court had no jurisdiction over a registered land. The Appellant was aggrieved by that decision thus, preferred the present appeal.
