The Appellant and the Respondent were husband and wife until 12.06.2012 when the Primary Court of Sumbawanga, found their marriage had irreparably broken down and formally dissolved the same. The Primary Court ordered distribution of matrimonial assets. Among the assets was a house which the court ordered that it be sold and the proceeds thereof distributed equally between the couple. The order to have the matrimonial house sold aggrieved the Appellant. She demands that the house not be sold instead be given to her to dwell with their last born child. She unsuccessfully appealed to the District Court which confirmed the decision of the Primary Court. She has thus come to the court as second appeal over the same complaint.
