This is the application in determination of the preliminary
objection as raised by the defendant herein in the suit instituted by the
plaintiff. The preliminary objection is based on three points of law, however
the Court determined two of them that; the matter before this court is Res
sub-judice and that the suit has been wrongly filed to this court despite
the voluntary agreement between the parties to submit themselves to the
Commercial Division of the High Court.
