This is an appeal against the sentence of the Medical
Council of Tanganyika dated 9th April, 2013 which was imposed on the
Appellant after pleading guilty to the charge of taking part in a strike which
act was interpreted by the said council as infamous conduct in terms of section
29 and 29 A of the Medical Practitioners and Dentists Act [Cap 152 R.E. 2002].
The particulars of the charge which was framed against him are that between 23rd
and 29th June, 2012 while on internship at Temeke Municipal
Hospital, he went on strike, the act which not only endangered lives of
patients but also amounted to breach of Code of Ethics and Professional Conduct
for Medical and Dental Practitioners in Tanzania. He was sentenced to being
erased from the Register of provisionally registered Medical Practitioners. The
Court is called upon to determine as to whether or not the sentence which was
imposed on the Appellant is excessive in the circumstances and discriminatory
in nature.
