The Appellant was tried and convicted for intentionally
killing. He was sentenced to suffer death by hanging, the mandatory sentence
for the offence of murder. As per trial judge, the evidence relied upon by the
prosecution was circumstantial and that evidence led irresistibly to the
Appellant as the only person who committed the offence. The learned trial judge
rejected defence of alibi as the defence was raised by the Appellant without
giving a prior notice and found that the Appellant was a liar. It was then the
Appellant was convicted as charged and sentenced as aforesaid. Being aggrieved
by the conviction and the sentence, the Appellant filed appeal challenging the
legality of his conviction and the sentence.
