The Applicant, who was at one time an employee of the
Respondent, instituted a suit against the Respondent in the District Court of
Bukoba. The suit was strike out on the ground of time limitation. Aggrieved,
the Applicant lodged his first appeal, in the High Court at Bukoba. The
Respondent filed a Notice of Preliminary Objection contending that the appeal
was accompanied with a defective extracted order. Before the delivery of the
Ruling on the Preliminary Objection, the Respondent and Applicant settled the
matter out of the Court and the appeal was withdrawn after the court had
granted the withdrawal order. Later on, the Applicant had a change of heart
about the concluded withdrawal of his appeal and, went back urging the High Court
to set aside its order of withdrawal. The Court dismissed the applicant’s
application for review of its order, hence, this application to this Court. In
his application to this Court several important documents were missing from his
application. In this appeal the Court ascertains appropriateness application
for revision of the High Court by the Applicant.
