This appeal arises from a ruling made by the Land Tribunal in Civil Suit No. 09/2013 whereby a preliminary objection taken by the Appellants against the Respondent, on the propriety of the suit filed by the Respondent Zahor Mzee Juma, was dismissed by the Tribunal. Dissatisfied, the Appellants filed the present appeal arguing, among others, that the Honourable Magistrate erred in law by determining the preliminary objection without fully involving the assessors, hence making the entire ruling a nullity.
