The applicants applied for stay of execution of the judgment
and decree of the High Court. In the process of execution, the matter was filed
in the High Court of Tabora in which the decretal amount which the applicant
had to pay the first respondent was calculated. The applicant was not satisfied
with that amount. He filed an application for review but the High Court of
Tabora dismissed the application. In an attempt to satisfy the decree, the
applicant paid part of the decreed sum. Failure to pay the remaining decretal
amount prompted the decree holder to file execution proceedings with a view to
attaching a house situate in Kijitonyama, Dar es Salaam. The decree was then
transferred from the Court of the Resident Magistrate at Tabora to the Court of
the Resident Magistrate at Kinondoni.
