The two Appellants were responsible for the killing of the
deceased who was the first Appellant’s very close friend and benefactor. The
conviction was based on Appellants’ confessions and the evidence of PW1. This
is a dissenting judgment by Kileo, J.A, regarding the sentence of death penalty
for the offence of murder. This judgment gives reasons why the death penalty
should not be imposed for the offence of murder.
