The Appellants and the Respondent are joint owners in equal
shares of the disputed house. The Appellants complained to have not benefiting
from such joint ownership with the Respondent, hence, lodged a suit in the High
Court seeking, among others, declaratory orders that they are lawful owners of
the disputed house and entitled to the share of the suit premise, or in the
alternative, an order for sell of the suit premises. After the hearing of the
case, the High Court dismissed the suit on the grounds that the applicants
failed to establish their case on the balance of probabilities. Aggrieved by
the decision of the Court, they appealed to this Court.
