This appeal originates from the decision of the High Court.
In the High Court the Appellant filed a suit against the Respondents for
payment for engineering works done by the Appellant. The work was based on
contract. However, the plaint neither disclosed the date on which the contract
was entered into nor was a copy of the contract agreement annexed to the
plaint. The Respondent filed a preliminary point of law to the effect that, the
claim is time barred. The Court upheld the preliminary objection and the suit
was struck out with costs. Aggrieved by the decision of the High Court, hence
this appeal.
