In this application the applicants are seeking to revise the
decision of the High Court of Zanzibar at Vuga. The main concern in this
matter, is that, the first Respondent once gave his two houses situated in
Zanzibar by way of Deed of Gift to his children. Later on, he was blessed with
other three children. He then successfully filed a Civil Case No. 13 of 2012 in
the High Court of Zanzibar revoking the two gifts on the reason that, he is not
in a position to build another house for the three children as he does not want
to deny them inheritance. After the revocation came to the knowledge of the
applicants, who were not party to the Civil Case No. 13 of 2012, they filed a
suit in the High Court. The suit was struck out on the ground that, the High
Court cannot assail its own decision in Civil Case No. 13 of 2012, hence, this
application.
