The applicant lodged the application by a Notice of Motion taken out under rule 89 (2) of the Tanzania Court of Appeal Rules, which sought to strike out a Notice of Appeal lodged by the Respondent on the grounds that they had not taken any step. The Respondent in response stated that it kept on following up the matter both orally and in writing but were told by the registry officers that they were not ready.
