This is an application for an extension of time to file a notice of appeal and the actual appeal out of time. The Court suo motu questioned the legality of the Applicants – who were also present in Court – being represented by one Mr. Mzuwanda Rashidi Gongo Mvalauhenga by virtue of a power of attorney. The parties agreed to file written submissions as the mode of addressing the Court in respect the issue of representation and an order for filling was made thereof. The Applicants did not file written submissions. Instead, the Applicants through an affidavit and certificate of urgency alleged that they had lost faith on presiding judge. During the hearing, Mr. Mzuwanda was given the opportunity to justify this kind of presentation. He adduced that the Applicants were unaware of the law and because of poverty, they could not afford the services of an advocate. That since he had some knowledge of the law as a certificate of law student, he was trying to improve his court knowledge through this kind of representation and he had previously represented different persons in many other cases of this nature. That the representation was done gratis as he was known to the Applicants who were neighbours.
