The plaintiffs are praying for a permanent injunction restraining the 1st and 2nd defendants, their agents and successors in title from dealing in any way with the suit property. That property is owned by the 1st plaintiff company, which in turn is owned 98% by Lushoto Tea Company Ltd. All the parties in the present case were parties in Commercial Case No. 62 of 2003, upon which issues as to the legality of the shares of the 1st plaintiff company and, consequently, the directorships of the defendants in the 1st plaintiff company were finally and conclusively. In the present case under paragraphs 8, 9, 10 and 11 of the plaintiffs question the decision of the court in a 2003 case. The defendants raise preliminary objection to the effect that the matter is res judicata and the plaint does not disclose a cause of action.
