The Plaintiff instituted the present suit against the Defendant praying for judgment and decree for several reliefs related to the ownership of a plot of land. Basically, his claim was that he was allocated the disputed piece of land by the City Council which had acquired the disputed plot and others from one George Shambwe. For his part, the Defendant who had developed the plot claimed that he purchased it from George Shambwe. It was advanced that the said George Shambwe had contested the acquisition in the court and consequently the acquisition was declared a nullity and that the court directed the Council to regularise the acquisition by payment of fair, adequate and prompt compensation to the said George Shambwe. The major issues that the High Court considered were whether the Plaintiff had any legal right over the disputed and to what relief(s) the parties were entitled?
