The Appellant instituted a land suit before the District Land and Housing Tribunal of Tarime seeking for a declaration that he was the lawful owner of a piece of land measuring 1.5 acres which is situated at Kemange Village in Tarime District. As he claimed, he had been allocated the disputed piece of land by the Village Council. He also prayed for general damages for trespass at the tune of Tanzanian Shillings 5,000,000/= and costs of the suit. After hearing both parties the District Tribunal ruled in Respondents’ favour. The Appellant was dissatisfied and he lodged an appeal to the High Court of Tanzania.
