The Respondent raised two points of objections that some of the plaintiffs did not serve the statutory notice of intention to sue the defendant. The High Court Judge considered the objection and found it with merit, and proceeded to strike it out with costs. According to him the statutory notice which was served to the defendants was in respect of only 84 people who were the intended plaintiffs claiming Tshs. 63,165,884/=.
