The Appellant and two others were charged with the offence
of armed robbery contrary to sections 285 and 286 of the Penal Code [Cap 16
R.E. 2002] as amended. The District Court of Mbozi, acquitted the other two,
convicted this Appellant and sentenced him to 30 years’ imprisonment and 6
strokes of the cane. His appeal in the High Court was summarily rejected after
obtaining an extension of time, he lodged this appeal. The court on its own
motion considered the validity of the summary judgment as well as the
conviction.
