The Appellant and two others who were acquitted by the trial court were charged with the offence of armed robbery contrary to section 287A of the Penal Code. The trial court relying on the doctrine of recent possession convicted and sentenced the Appellant to serve 30 years’ imprisonment. In his appeal in the High court, in addition to the sentence meted by the trial court it was ordered that the Appellant get 12 strokes of the cane. Dissatisfied, the Appellant preferred the second appeal to the Court of Appeal.
