The Appellant was charged with the offence of being found in possession of human body parts contrary to section 222A of the Penal Code [Cap 16 R.E. 2002]. It was alleged that on 20.08.2007 the wife of one Frank Athanas who testified as PW1 gave birth to a still-born baby boy. Later, on 22. 08.2007 the body of the dead baby boy was found in a nearby trees suspected to have been unearthed missing some body parts including a heart. The said Frank Athanas identified a kanga cloth which used to wrap the body of his baby when burying. It is also alleged that the Appellant was seen in the cemetery where the baby was buried saying he was looking for a human being oil. The Appellant was later arrested and charged in connection with the offence.
