The Respondent applied for letters of administration of her
late father Aizack Mpangala’s estate before Songea Urban Primary Court. The
Appellant was against the majority views that the properties forming part of
the deceased estate all be sold and distributed to the beneficiaries them being
many. The trial court on application of other beneficiaries ordered the
properties to be sold. The Appellant being aggrieved she sought for the
revision of the matter before the Songea District Court arguing that the Court
erred when it ordered that the estate of the deceased be sold arguing that this
was ultra vires as the District Court acted beyond the powers vested to
it. The district court found that there was nothing to revise hence upheld the
trial court’s decision. Aggrieved by that decision the Appellant appealed to
the High Court.
