This suit was filed by the plaintiff against the Attorney General Zanzibar and Katibu wa Halmashauri Wilaya ya Kaskazini “B”. The suit is in respect of the revocation of the plaintiff’s certificate right of occupancy over plot No. 547 situated at Kiwengwa Kairo North B District Unguja. The Right of Occupancy was granted to the plaintiff in 2008 for residential purposes. Later the plaintiff was granted a building permit for that purpose from the 2nd defendant and commenced construction by fencing the plot.
In 2014 the plaintiff’s grant was revoked and the plot was granted to the Principal Secretary Ministry of Education and Vocational Training. It was after the revocation and the grant of the plot to the Principal Secretary Ministry of Education and Vocational Training and when the Principal Secretary started the process of applying for the building permit from the 2nd defendant when the plaintiff instituted this suit. The plaintiff basically challenges the Minister’s acts of revoking the grant of the plot to her and granting the same to the Principal Secretary Ministry of Education and Vocational Training.
In their joint written statement of defence the defendants categorically denied the plaintiff’s claims contending that the revocation of the plaintiff’s grant and the grant of the plot to the Principal Secretary Ministry of Education and Vocational Training was legally done on public interest.
