The Plaintiff was employed by 2nd Defendant as
supervisor of loading of cargo at the warehouse. One day the cargo went missing
after they were loaded on a Fuso lorry at the warehouse. The Plaintiff being a
supervisor was included as one of the accused persons in a criminal case. At
the closure of the prosecution case, the plaintiff, was found to have a case to
answer. However, the court ultimately acquitted him. Aggrieved by the decision
to charge him in a criminal case, he filed this suit for malicious prosecution
against the Respondents. The Court determined the principles upon which the
tort of malicious prosecution is based.
