The Respondent successfully sued the applicant in the High
Court for breach of contract of supply of goods and services. The Court entered
judgment in favour of the Respondent who was granted Tshs. 1,920,998,317.79 and
USD 143,484.72 being costs of goods and services supplied and Tshs. 20,000,000
as general damages. Aggrieved by the judgment and decree of the High Court the
Appellant appealed to this Court. In order to forestall the execution of the
decree, the applicant is presently seeking an order for stay of the execution
pending the hearing and determination of the intended appeal.
