This is an appeal originating from the High Court of
Zanzibar at Vuga. The case was decided in favour of the Respondent, following
the Appellant’s failure to produce discovery documents as ordered by the Court.
During the hearing of the appeal, the Court, suo motu drew the attention
of the learned Counsel for the Appellant to the pertinent defects on the face
of the record of the appeal lodged. The main issue before the Court was whether
or not those defects on the face of the record render the appeal incompetent.
