The Respondents sued the applicant in the High Court, on a
variety of claims arising from a contract of redemption of mortgages, discharge
of hypothecation of a goods bond, as well as the torts of detinue and
negligence. At the conclusion of the trial, the Court entered judgment in
favour of the Respondents. Dissatisfied, the applicant lodged an appeal in this
Court challenging the decision of the High Court. At the same time, the
applicant, filed this application under a certificate of urgency, for an order
to stay the execution of the decree of the High Court pending the hearing and
determination of the intended appeal.
