The four Appellants, were arrested by the police at different
dates for being suspected of killing, one, Mackdonald Wahenga at Kipunguni
Ukonga area in Dar es Salaam. The Appellants were arrested by the police and
caution statements were taken at different time. Later, the Appellants were
arraigned in High Court and upon hearing of the case the trial court was
satisfied that the prosecution proved the charge beyond doubts. It accordingly
convicted all the four Appellants and sentenced each of them to suffer death by
hanging. Dissatisfied, the Appellants filed a joint memorandum of appeal
consisting of fifteen (15) grounds of appeal. The issue before the Court is
whether the grounds of appeal raised by the Appellants are robust to allow the
appeal.
