This appeal originates from the decision of the High Court.
The Appellant sued the Respondent for breach of contract for failure to supply
raw cotton for exportation. The Appellant filed a dispute before the
International Cotton Association Tribunal based at Liverpool in England. The
Respondent did not enter appearance resulting into hearing of the matter ex-parte.
The Tribunal gave an award in favour of the Appellant. Armed with the award,
the Appellant lodged an application before the High Court for its registration
and execution. Upon being served with the notice of the application for
registration of the award, the Respondent petitioned the Court for the award to
be set aside alleging that there was no contract between them. The Court
decided in favour of the Respondent. Aggrieved with the decision of the Court,
Appellant preferred this appeal.
