This appeal originates from the decision of the High Court
on general elections of 2015 held in Bunda Urban Constituency in Mara Region.
The parliamentary election in the Constituency was contested by Stephen Masato
Wasira CCM, Esther Amos Bulaya CHADEMA, Maganja Yeremia of ACT, Ascetic
Malagila of DP and Dr. Lucas Webiro of TLP. After the election, Esther Amos
Bulaya (1st Respondent) was declared the winner. Aggrieved by the
election results Appellants filed a petition against the Respondents in the
High Court. Having considered the parties’ evidence and final submissions filed
by the parties, the High Court found the petition devoid of merit and dismissed
it on the ground that the evidence tendered by the Appellants did not prove the
claims to the standard required in an election petition. The Appellants were
aggrieved by the decision of the High Court hence this appeal.
