At the Resident Magistrate’s Court, Mtwara, the two
Respondents in this appeal were arraigned on a charge that contained three
counts. After the trial the court was not convinced that the prosecution had
proved the case against the Respondents to the required standard. It acquitted
both of them of all counts. The Director of Public Prosecutions was not
satisfied. He instituted this appeal.
