The Appellant was charged with and convicted of being in possession of narcotic drugs (bhang). He was sentenced to five years’ imprisonment. Aggrieved by the decision of the trial court he appealed to the High Court contending that he was convicted on the basis of insufficient evidence and the sentence meted out to him was excessive and inappropriate as it denied him of an alternative punishment of payment of a fine. The counsel for the Respondent (the Republic) declined to support the Appellant’s conviction. She contended that the prosecution should have called neutral witnesses apart from the only police officers who gave evidence.
