This appeal originates from the District Court of Ngara
District at Ngara, whereby, seven accused persons were charged and convicted of
two offences, namely, unlawful grazing of livestock in a Game Reserve and
unlawful entry into a Game Reserve contrary to the provisions of the Wildlife
Conservation Act, 2009. Following the conviction and sentence of the above
accused persons and the forfeiture order, the Appellant filed an appeal to the
High Court against the conviction, sentence and forfeiture order of the
District Magistrate Court Ngara. Their appeal to the High Court was
unsuccessful hence this second appeal to this Court. The main issue before the
Court was whether a third interested party can successfully appeal in a
criminal case.
