This is an appeal emanating from the judgment and decree of the court of the Resident Magistrate of Dar es Salaam sitting at Kisutu in which the Appellant was ordered to pay the Respondent, Tshs. 80,000,000/= as general damages. The Appellant is a microfinance institution dealing with, inter alia, lending money to its customers. The Appellant used to lend money to the Respondent. Some times in the year 2010, the Respondent obtained a loan of Tshs. 12,000,000/= from the Appellant alongside which a house belonging to the Respondent was pledged as security. The Respondent was unable to repay the loan. She thus entered in some arrangement with another person who would be making deposits in service of the loan. Thereafter, this other person made several deposits on the loan account in repayment of the loan. It is the Respondent’s case that in the course of making those deposits, the Appellant breached the duty of confidentiality between them by disclosing her financial affairs to the third person. The Respondent thus filed the suit the subject of this appeal which was ultimately decided in her favour.
