The Appellant and Respondent were wife and husband respectively. The Respondent (the husband) filed a petition of divorce in the Resident Magistrate Court. The Court decided that the marriage had broken down irreparably and divided the assets (three houses), which were acquired through the joint efforts of the parties. For various reasons, all parties were dissatisfied by the decision of the trial court with regard to division of matrimonial properties and thus appealed and cross-appealed to the High Court. The Appellant raised a preliminary objection to the cross-appeal that the Respondent’s memorandum of objection was not accompanied by a copy of decree appealed from and (unless the court dispenses with) a copy of judgment on which it is founded.
