This appeal arises from the decision of the magistrate of
the Land Tribunal in Civil Case No. 68/2015 at Koani, Zanzibar. The background
to the case is that the Appellant filed a Civil Suit No. 68 of 2015 at the Land
Tribunal against the Respondent. The Appellant’s claim is that he is the owner
of a plot of land (eka) situated at Manyame, Machui in the Central district of
Unguja, which he was granted by Department of Land and Registration through a
letter dated 5/7/2013. He added that on 2013 the Respondent trespassed on that
land and planted various permanent trees. The Respondent acknowledged that the
Appellant has a land in that area, but avers that he also owns a plot of land
(eka) which he was granted by Department of Land and Registration through a
letter dated 30/7/2015.
The learned Magistrate of the Land Tribunal heard the
matter and delivered his judgment against the Appellant on 24/04/2019. The
Respondent was declared to be the owner of the disputed land, and the Appellant
was ordered to remove his hands in the disputed land. The Appellant being
aggrieved with the said decision preferred this appeal.
